DMCA Policy for Merriment Meadow

1. Introduction

2. Copyright Infringement Notification Process

For your complaint to be valid under the DMCA, you must provide the following information in writing:

4. Response to Copyright Infringement Claims

Upon receipt of a valid DMCA notice, we will respond expeditiously to remove, or disable access to, the material that is claimed to be infringing or to be the subject of infringing activity. We will also notify the user who posted the content of the infringement claim and provide them with an opportunity to respond with a counter-notification under Sections 512(g)(2) and (3) of the DMCA.

5. Counter-Notification Procedures

If you receive a notification from Merriment Meadow that material made available by you on or through the website has been the subject of a DMCA notice, you will have the right to provide us with what is called a “Counter-Notification.” To be effective, a Counter-Notification must be in writing, provided to our Copyright Agent, and include substantially the following information:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
  • Your name, address, telephone number, and, if available, email address, and a statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if your address is outside of the USA, for any judicial district in which Merriment Meadow may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Upon receipt of a valid Counter-Notification, Merriment Meadow will promptly provide the person who provided the original DMCA notice with a copy of the Counter-Notification, and inform that person that Merriment Meadow will replace the removed material or cease disabling access to it in 10 business days. Merriment Meadow will replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the Counter-Notification, unless our Copyright Agent first receives notice from the person who submitted the original DMCA notice that such person has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on Merriment Meadow’s website.

6. Modifications to the Policy

Merriment Meadow reserves the right to modify the provisions of this DMCA policy at any time. A notice regarding any such changes will be posted on our website or sent to you via email.
